This book takes us far beyond the usual focus of comparative law with analysis of a broad range of jurisdictions, including mixtures of common and civil law, and also those mixing Islamic and/or traditional legal systems with those derived from common and/or civil law traditions. The discussion is situated within the broader context of the continuing tides of globalization, the emergence of Islamic governments in some parts of the Middle East, the calls for a legal status for Islamic law in (...) some European countries, and the increasing focus on traditional and customary norms of governance in post-colonial contexts. Companies offer ethics codes and training to increase employees' ethical conduct. These programs can also enhance individual work attitudes because ethical organizations are typically valued. Socially responsible companies are likely viewed as ethical organizations and should therefore prompt similar employee job responses. Using survey information collected from 313 business professionals, this exploratory study proposed that perceived corporate social responsibility would mediate the positive relationships between ethics codes/training and job satisfaction. Results indicated that corporate social responsibility fully or partially mediated the (...) positive associations between four ethics program variables and individual job satisfaction, suggesting that companies might better manage employees' ethical perceptions and work attitudes with multiple policies, an approach endorsed in the ethics literature. Ethics training is commonly cited as a primary method for increasing employees ethical decision making and conduct. However, little is known about how the presence of ethics training can enhance other components of an organization's ethical environment such as employees perception of company ethical values. Using a national sample of 313 business professionals employed in the United States, the relationship between ethics training and perceived organizational ethics was explored. The results of the analysis provide significant statistical support for the notion (...) that businesspersons employed in organizations that have formalized ethics training programs have more positive perceptions of their companies ethical context than do individuals employed in organizations that do not. The analysis also indicated that job satisfaction was related to employees attitudes about their ethical context. ABSTRACT Contemporary US discourse on reparations tends to focus on the suppression of Black economic interests, but the harms of slavery are not exhausted by the labor expropriation of slaves and its concomitant wealth accumulation for white people and the United States at large. Reproductive oppression was constitutive of the institution of slavery, and its harms continue to reverberate today. This article thus calls for reproductive reparations, or the transparent and sustained attention to the effects of racialized reproductive oppression as (...) they intersect with calls for reparations for slavery. Reconceiving reparations through histories and presents of reproductive harm is required to more fully account for the wrongs of slavery and provide a broader reach for radical societal transformation in our present. This study assessed the relationship between ethical reasoning and the decision to grant equitable relief using an innocent spouse vignette where a wife had partial knowledge of her husband''s tax fraud. A path model derived from various ethics theories was tested using a sample of 357 accounting, legal, and human resource professionals, and after careful examination of the measurement and structural relationships in the path model, the results provided partial support for the study''s hypotheses. Moral intensity was marginally associated with (...) an increased recognition of an ethical issue and positively related ethical judgments made in an innocent spouse situation, and moral intensity was also negatively related to the decision to grant relief. The ethical judgment variable was positively related to the decision to grant relief, while ethical issue awareness was marginally associated with the decision to deny relief. The implications of these findings are discussed, along with the limitations of the study and suggestions for future research. (shrink)

John Palmer develops and defends a modal interpretation of Parmenides, according to which he was the first philosopher to distinguish in a rigorous manner the fundamental modalities of necessary being, necessary non-being or impossibility, and non-necessary or contingent being. This book accordingly reconsiders his place in the historical development of Presocratic philosophy in light of this new interpretation. Careful treatment of Parmenides' specification of the ways of inquiry that define his metaphysical and epistemological outlook paves the way for detailed (...) analyses of his arguments demonstrating the temporal and spatial attributes of what is and cannot not be. The purpose of this study was to determine the degree to which the review of corporate ethics codes is associated with individuals’ perceptions of the importance of virtue ethics, or more specifically, employee incorruptibility. A convenience sample of individuals working for a university or one of several business organizations located in the Mountain West region of the United States was compiled with a self-report questionnaire. A usable sample of 143 persons representing both the public and private industries was secured for (...) use in this study. The results of an analysis of covariance showed that reviewing ethics codes during employee orientation was positively related to individuals’ beliefs that incorruptibility is an important individual virtue. This research note presents a thesis research led on the social representations of the amputated body fitted with prostheses, in the light of the contemporary collective imagination. The main aim was to observe, compare and analyse the way in which the public and media consider the field of prostheses, and bring these collective projections and imaginations face to face with how the amputees (but also the caregivers who surround them) see themselves and construct their own social and bodily identity. The (...) goal was to reveal the existence of a certain gap between what the collective discourse producers (media, scientists) think to know about amputees and prostheses, and the reality observed on site (practical problems, customs and practices of everyday life). The final aim was to formulate proposals to overcome these ambiguous conceptions, to question the notions of social inclusion and exclusion of disability and the technological repairs of the body, and to put the amputees at the heart of more rational, pragmatic and ethical considerations, far from any prediction, speculation and phantasmagoria. The purpose of this study was to assess the relationships among ethical context, organizational commitment, and person-organization fit using a sample of 304 young working adults. Results indicated that corporate ethical values signifying different cultural aspects of an ethical context were positively related to both organizational commitment and person-organization fit. Organizational commitment was also positively related to person-organization fit. The findings suggest that the development and promotion of an ethical context might enhance employees' workplace experiences, and companies should consider adopting (...) ethical policies that support principled conduct, punish unethical actions, and increase individual perceptions of an ethical company environment. Previous work suggests that moral intensity and the perceived importance of an ethical issue can influence individual ethical decision making. However, prior research has not explored how the various dimensions of moral intensity might differentially affect PIE, or how moral intensity might function together with (or in the presence of) PIE to influence ethical decision making. In addition, prior work has also not adequately investigated how the operational context of an organization, which may embody conditions or practices that create barriers (...) to ethical decision making, may differ from other functional areas of an organization. Consequently, this study investigated the relationships among moral intensity, perceived ethical issue importance, and three stages of the ethical reasoning process: recognition of an ethical issue, ethical judgment, and ethical intention. Using an internet-based, self-report survey containing two operations management scenarios and various ethics measures, information was collected from business professionals working for a Midwestern financial services organization. The hierarchical regression results indicated that some dimensions of moral intensity were positively related to PIE, ethical issue recognition, and ethical judgment, and that PIE was associated with increased ethical issue recognition and ethical judgment. The book first analyzes Freud's claim that religion is an obsessional neurosis, a psychological illness fueled by sexual repression. _Clinical Trials and the African Person_ offers an account of the African notion of the self/person within the clinical trials context. As opposed to autonomy-based principlism, this other-regarding/communalist perspective is touted as the preferred alternative model particularly in multicultural settings.

Role conflict occurs when a job possesses inconsistent expectations incongruent with individual beliefs, a situation that precipitates considerable frustration and other negative work outcomes. Increasing interest in processes that reduce role conflict is, therefore, witnessed. With the help of information collected from a large sample of individuals employed at an education-based healthcare institution, this study identified several factors that might decrease role conflict, namely mindfulness and organizational ethics. In particular, the results indicated that mindfulness was associated with decreased role conflict, (...) and that perceived ethical values and a shared ethics code were associated with decreased role conflict and increased mindfulness. Despite the study's limitations, these findings imply that companies might better manage role conflict through the development of mindfulness and organizational ethics. (shrink)

Little is known about how ethical organizational contexts influence employees’ perceived stress levels and well-being. This study used two theoretical lenses, ethical impact theory (Promislo et al. in Handbook of Unethical Work Behavior, M.E. Sharpe, Armonk, 2013) and ethical decision-making theory (Schwartz in J Bus Ethics 139(4): 755–776, 2016), to investigate the relationships among perceived organizational ethics (comprised of ethical climate, leader/manager ethics, and corporate social responsibility), work-related stress, and employee well-being (comprised of vitality, life satisfaction, personal growth initiative, flourishing, (...) positive mental health, and self-actualization). Findings across two studies indicated that organizational ethics was negatively related to work-related stress, and that work-related stress was negatively related to employee well-being. Perceived organizational ethics is positively related to employee well-being, with post hoc mediation tests indicating that work-related stress partially mediates this relationship. Our findings suggest that organizations should be proactive in improving their ethical climate, such as choosing ethical leaders, developing a robust and well-communicated code of ethics, and actively practicing CSR. These measures should reduce excessive work-related stress and improve employee well-being. (shrink)

While the principles of reproductive justice are generally agreed upon in progressive reproductive political circles, other theoretical frameworks such as reparative justice can further foster the goals of the movement. In the literature, however, reparative justice has been insufficiently explored as it relates to reproductive injustice. My concern in this essay is therefore the development of conceptual architecture for understanding reproductive justice as reparative in nature. A reparative approach to reproductive ethics importantly takes up the demand to situate reproduction within (...) ongoing historical and sociopolitical contexts. It makes transparent the harms generated by an oppressive social order and the depths to which conditions must change for reproductive justice to emerge. To construct the relationship between reparative and reproductive justice, I employ Olúfemi Táíwò’s constructivist view of reparations as an ongoing, generative, and ultimately world-building project. For, if reproductive justice is about developing enabling conditions wherein folks can control their birthing options and parent in safe and healthy environments, then a constructivist reparative approach is necessary—one which takes seriously the accumulative harms of history and their relation to transforming social structures in the present. The law and society occasionally impute consent to an agent despite a clear lack of actual consent. A common type of such ‘fictitious consent’ is constructive consent. In this practice, we treat an agent as if she consented to Φ because she did Ψ. By examining how constructive consent operates in law and daily life, I show that our treatment of agents in these cases bears no normatively relevant resemblance to consent because it is grounded in values and concerns other (...) than autonomy. Thus, the practice may diminish the very autonomy consent proper seeks to promote. Hiding this potential for conflict creates the risk moral concerns will not be appropriately balanced when deciding on the permissibility of an action. Amputation is a chronic condition. The amputation of a limb (arm or leg) profoundly upsets the biographical thread of the person going through this ordeal, and determines the entire organization of his or her life in the long term. It entails a heavy process of learning, appropriation, and development of knowledge and skills. While this process is built up in a brutal and profound way in the early stages following the amputation, it also continues, because of its chronic dimension, throughout (...) the life of the amputee. The objective of this article is to highlight the different stages of this complex process and their respective stakes: from the shaping of the body during and after surgery, to adaptive learning of daily situations, to the taming of body postures and prosthesis. We also point out the extent to which devices such as interdisciplinary care, Therapeutic Patient Education or peer support can be decisive for the conditions and possibilities of rehabilitation of amputee patients with prostheses. How far apart are humans from animals—even the “vampire squid from hell”? Playing the scientist/philosopher/provocateur, Vilém Flusser uses this question as a springboard to dive into a literal and a philosophical ocean. “The abyss that separates us” from the vampire squid “is incomparably smaller than that which separates us from extraterrestrial life, as imagined in science fiction and sought by astrobiologists,” Flusser notes at the outset of the expedition. Part scientific treatise, part spoof, part philosophical discourse, part fable, _Vampyroteuthis Infernalis_ (...) gives its author ample room to ruminate on human—and nonhuman—life. Considering the human condition along with the vampire squid/octopus condition seems appropriate because “we are both products of an absurd coincidence... we are poorly programmed beings full of defects,” Flusser writes. Among other things, “we are both banished from much of life’s domain: it into the abyss, we onto the surfaces of the continents. We have both lost our original home, the beach, and we both live in constrained conditions.” Thinking afresh about the life of an “other”—as different from ourselves as the vampire squid/octopus—complicates the linkages between animality and embodiment. Odd, and strangely compelling, _Vampyroteuthis Infernalis_ offers up a unique posthumanist philosophical understanding of phenomenology and opens the way for a non-philosophy of life. (shrink)

The purpose of this study was to investigate the relationship between organizational ethical context and the individual ethical decision-making process. In addition, a new statistical approach combining cluster and discriminant analyses was developed to overcome violations of regression assumptions, which are commonly not identified and/or ignored in behavioral and psychological research. Using regressions and this new alternative method, the findings indicated that ethical context does indeed influence the various components of ethical reasoning. However, social desirability was the strongest predictor of (...) ethical decision making, which raises new concerns about how this bias can confound business ethics research. Finally, the findings showed that the alternative method provided more useful and interpretive results, indicating that it has the capacity to influence future empirical work in the field of business ethics, particularly when dealing with data that do not satisfy regression assumptions. The implications and limitations of the study are discussed, and several noteworthy suggestions for future research are provided. (shrink)

Recent philosophical discussion about the relation between fiction and reality pays little attention to our moral involvement with literature. Frank Palmer's purpose is to investigate how our appreciation of literary works calls upon and develops our capacity for moral understanding. He explores a wide range of philosophical questions about the relation of art to morality, and challenges theories that he regards as incompatible with a humane view of literary art. Palmer considers, in particular, the extent to which the (...) values and moral concepts involved in our understanding of human beings can be said to enter into our understanding of, and response to, fictional characters. This study explores differences between executives in the U.S. and Spain in their perceptions of ethical issues in pricing, specifically comparing a domestic firm's actions affecting a foreign market versus a foreign firm's actions affecting the domestic market. Overall, Spanish and American executives provided somewhat different responses to the scenarios. Findings indicate that ethical judgments and intentions among Spanish executives did not vary based on which country was harmed. U.S. executives generally perceived that a morally questionable act directed at a (...) foreign country was more unethical than a morally questionable act directed at the United States. Propositional attitude verbs, such as think and want, have long held interest for both theoretical linguists and language acquisitionists because their syntactic, semantic, and pragmatic properties display complex interactions that have proven difficult to fully capture from either perspective. This paper explores the granularity with which these verbs’ semantic and pragmatic properties are recoverable from their syntactic distributions, using three behavioral experiments aimed at explicitly quantifying the relationship between these two sets of properties. Experiment 1 gathers a measure of 30 (...) propositional attitude verbs’ syntactic distributions using an acceptability judgment task. Experiments 2a and 2b gather measures of semantic similarity between those same verbs using a generalized semantic discrimination task and an ordinal scale task, respectively. Two kinds of analyses are conducted on the data from these experiments. The first compares both the acceptability judgments and the semantic similarity judgments to previous classifications derived from the syntax and semantics literature. The second kind compares the acceptability judgments to the semantic similarity judgments directly. Through these comparisons, we show that there is quite fine-grained information about propositional attitude verbs’ semantics carried in their syntactic distributions—whether one considers the sorts of discrete qualitative classifications that linguists traditionally work with or the sorts of continuous quantitative classifications that can be derived experimentally. Husserl's marginal remarks in Kant und das Problem der Metaphysik clearly do not reflect the same intense effort to penetrate Heidegger's thought that we find in his marginal notes in Sein und Zeit. Merely in terms of length, Husserl's comments in the published German text occupy only one-third the number of pages.2 Pages 1-5, 43-121, and 125-1673 contain no reading marks at all-over half of the 236 pages of KPM. This suggests that Husserl either read these pages with no intention (...) of returning to the text or skipped large parts of the middle of the text altogether.4 His remarks often express frustration or a resigned recognition of the now unbridgeable, irrevocable gap between himself and Heidegger. We give a combinatorial analysis (using edge expansion) of a variant of the iterative expander construction due to Reingold, Vadhan, and Wigderson [44], and show that this analysis can be formalized in the bounded arithmetic system VNC^1 (corresponding to the “NC^1 reasoning”). As a corollary, we prove the assumption made by Jeřábek [28] that a construction of certain bipartite expander graphs can be formalized in VNC^1 . This in turn implies that every proof in Gentzen's sequent calculus LK of a (...) monotone sequent can be simulated in the monotone version of LK (MLK) with only polynomial blowup in proof size, strengthening the quasipolynomial simulation result of Atserias, Galesi, and Pudlák [9].
